- “Operator” means the independent person or business selected by the Traveler to organize and perform the booked Travel Service.
- “Travel Service” means a tour, activity, experience, admission, transfer or other service listed on the Platform.
- “Booking” means an accepted and confirmed request for one or more Travel Services.

3 Role of TakeMe Exploring
TakeMe Exploring provides an intermediary marketplace through which Travelers can search, compare and book Travel Services offered by independent Operators. The Traveler chooses the preferred activity and Operator from the available options. When a Booking is confirmed, the contract for performance of the Travel Service is made directly between the Traveler and the selected Operator.
The Operator is solely responsible for organizing and performing the Travel Service in accordance with the published description, Booking confirmation, Specific Conditions and applicable law. TakeMe Exploring does not organize or physically perform the activity and acts only as the marketplace intermediary, unless a future listing clearly states a different model before purchase.
TakeMe Exploring facilitates listing, booking, payment collection, information exchange, confirmation, communications and initial issue support. As part of this intermediary role, TakeMe Exploring is authorized to receive payment from the Traveler on the Operator’s behalf. A payment successfully made through the Platform satisfies the Traveler’s payment obligation for the amount collected.
TakeMe Exploring will settle the relevant amount with the Operator under the Operator agreement after the Service has been performed. Settlement may be temporarily held where a complaint, refund request, chargeback, fraud review or other unresolved dispute affects the Booking. This internal arrangement does not reduce or delay any right available to the Traveler under applicable law or the Booking policy.
The Operator’s identity must be displayed in the listing, during checkout or in the confirmation. Nothing in these Terms limits mandatory consumer rights.
4 Acceptance and eligibility
Access to and use of the Platform constitutes acceptance of these Terms to the extent permitted by law. Before payment, the User must expressly accept the current Terms, the Specific Conditions and any applicable notices.
Minimum age to hold an account or contract: 18 years old.
A person booking for others confirms that they are authorized to do so, have shared the relevant information and will provide accurate participant details. The lead Traveler must ensure all participants understand and satisfy the Service requirements.
5 User accounts and security
Where accounts are available, Users must provide accurate, complete and current information and protect their login credentials. Suspected unauthorized use must be reported promptly. TakeMe Exploring may reasonably verify, restrict or close an account in cases of fraud, impersonation, security risk, serious breach or legal obligation and will provide notice where practicable.
6 Service information and search results
Listings are prepared from information supplied by Operators and may be reviewed by TakeMe Exploring. They may include itinerary, duration, languages, availability, meeting or pickup point, inclusions, exclusions, accessibility, restrictions, group size and cancellation policy.
TakeMe Exploring seeks to keep information clear and current, but operational details may change for justified reasons. The Traveler must review the full listing before booking and the confirmation and updates before attending. Material changes will be addressed under the applicable policy and law.
7 Booking and confirmation
To book, the User selects the Service, the Operator where alternatives are offered, date, time, participant details and available options. Before confirmation, the Platform will show the Operator, total price, currency, known charges and cancellation policy.
A request is not confirmed until confirmation is issued by email, account notification or another stated channel. Some Services require later Operator confirmation. If unavailable, an alternative may be offered; if not accepted, the request will be cancelled and any collected amount refunded according to the payment method timing.
8 Voucher and Booking documents
The confirmation or voucher will state the essential Service details and operational contact information where relevant. The User must promptly check names, date, time, location and participants and report errors without delay.
The Traveler must present the voucher in the requested format and carry all stated identification, permits or documents. Failure to satisfy a clearly disclosed mandatory requirement may result in refused participation without refund where legally valid.
9 Prices currencies taxes and payments
The applicable price is the price shown before Booking confirmation. The Platform will identify the currency, included taxes, known mandatory charges and any amount payable directly to the Operator. Optional extras and personal expenses are excluded unless expressly stated.
Currencies and conversion: The currencies available for displaying prices on the Platform are United States dollars (USD), euros (EUR), pounds sterling (GBP), and Mexican pesos (MXN). Regardless of the currency selected for display, all payments will be processed in Mexican pesos (MXN). During checkout, the displayed amount will be converted into MXN using the applicable exchange rate available at the time the transaction is processed. The exchange rate and the resulting amount in MXN will be shown to the Traveler before the purchase is confirmed.
A bank transaction fee may be applied as a percentage of the final purchase amount. Where applicable, this fee will be clearly itemized during checkout and included in the total amount payable before the Traveler confirms the purchase. The Traveler’s bank or card issuer may apply additional currency-conversion fees, international transaction charges, or other fees independently of TakeMe Exploring.
Payment methods and processors: TakeMe Exploring accepts most credit and debit cards, as well as other payment methods that will be visible to the user at checkout.
A bank or payment provider may impose fees or conversions outside TakeMe Exploring’s control. A rejected, incomplete or reversed payment may prevent confirmation or lead to cancellation, with notice where practicable.
TakeMe Exploring facilitates or processes collection as intermediary and collection agent for the Operator. Funds are administered and settled under the applicable Operator agreement after performance, subject to valid adjustments for refunds, chargebacks, complaints, fraud or non-performance.
Transactions showing reasonable signs of fraud, unauthorized use or an obvious pricing error may be cancelled. For an obvious pricing error, the User will be offered the correct price or a refund, without limiting statutory rights.
Invoices and receipts: To request an invoice, please email info@takemeexploring.com within 10 days of making your payment and/or before the end of the fiscal month. It will not be possible to issue an invoice after that date.
10 Traveler-requested changes
Changes depend on availability, the Service policy and Operator approval and are not effective until confirmed in writing. A price difference or disclosed fee may apply. If a change cannot be made and the Traveler cancels, the accepted cancellation policy and mandatory law will apply.
11 Cancellations refunds and no shows
Each Service has a specific cancellation policy displayed before payment and reproduced or linked in the confirmation. It sets out deadlines, charges, refundable amounts and the cancellation process.
Requests must use the designated channels and are effective when the complete request is recorded. A general inquiry does not necessarily constitute a confirmed cancellation. Late arrival, attendance at the wrong place, no-show or failure to meet a clearly disclosed requirement may result in loss of participation and refund rights, subject to law and the applicable policy.
Refund processing time: The refund timeframe depends entirely on the banks involved in the transaction and may take up to 20 calendar days, depending on the User's bank.
Refunds will normally be returned to the original payment method. Currency fluctuations and bank charges will be handled under applicable law and the financial provider’s terms.
12 Operator changes or cancellation
As the party solely responsible for performance, the Operator must deliver the Service as published and confirmed. It may change or cancel for availability, weather, safety, closures, authority decisions, guide illness, transport failure, strikes, local events or circumstances beyond reasonable control.
For a material change or pre-service cancellation, the Traveler will be informed promptly and, as appropriate, offered an equivalent alternative, new date, voluntary credit or refund. A Traveler need not accept credit where the law provides a refund right.
Any expenses incurred by the User that are separate from and not expressly included in the Reservation—including flights, accommodation, visas, insurance, or independently arranged transportation—will not be included in or added to any refund relating to the Tour or Activity. Subject to applicable law, the maximum refund payable by TakeMe Exploring or the selected Operator in connection with the Reservation will be limited to the amount actually paid by the User for the affected Tour or Activity.
13 Punctuality, pickups and transfers
The User must arrive at the designated time and verify the meeting or pickup point. For transfers, the User must provide accurate details regarding the flight, terminal, accommodation, schedule, luggage, and number of passengers.
Waiting times, included zones, vehicle capacity, luggage allowances, child seats, surcharges, flight tracking, and delay policies will be specified in advance by the Service Operator.
General transfer rules: A 30-minute waiting period at the airport applies upon the User's arrival. In the event of flight delays, measures to ensure the client's pickup will be taken—provided time permits and/or the User notifies the Operator of the delay in advance—though this does not constitute a contractual obligation.
The User is entitled to a free luggage allowance of one suitcase (maximum 23 kg) and one piece of hand luggage per person. If the User travels with more than one large suitcase, the Operator may charge an additional fee per suitcase.
As a general rule, airport-hotel-airport transfer services do not include child seats. If required, the User must request them from the selected Operator in advance, and an additional fee may apply for this service.
14 Traveler obligations
Users and participants must:
- provide accurate information and monitor the Booking contact channels;
- follow reasonable safety, conduct and destination-protection instructions;
- respect schedules, property, communities, staff, other Travelers and local rules;
- disclose relevant accessibility, health, mobility, age, pregnancy, allergy or other restrictions before booking where needed to assess suitability;
- obtain required passports, visas, permits, insurance and personal documents; and
- not participate while impaired in a manner that compromises safety or carry prohibited items.
The Operator may refuse or stop participation where a reasonable safety risk or breach of an essential disclosed requirement exists. Any refund depends on the facts, applicable policy and law.
15 Accessibility health and activity characteristics
Physical, environmental and accessibility conditions vary by Service. Travelers should review the listing and ask before booking if adjustments or additional information are needed. Disclosure does not itself guarantee suitability; TakeMe Exploring and the Operator will state what can reasonably be offered. Difficulty descriptions are guidance and do not replace medical advice.
16 Reviews photographs and User content
Users may be permitted to submit verified reviews, text, photographs or other content. The User retains ownership and grants TakeMe Exploring a non-exclusive, worldwide, royalty-free and sublicensable license to host, reproduce, format, translate, moderate and display it on the Platform and related promotional channels as needed and in accordance with the Privacy Notice.
Content must not be false, discriminatory, defamatory, illegal, covertly promotional, manipulated or infringe privacy or intellectual property. TakeMe Exploring may moderate or remove content for legal, safety, authenticity or compliance reasons. Sponsored reviews or permitted incentives must be clearly identified.

17 Permitted use of the Platform
Users must act lawfully and in good faith and must not:
- impersonate another person, submit false data or access another account;
- make fraudulent bookings, test cards, resell without authorization or evade restrictions;
- introduce malware, interfere with security or attempt unauthorized system access;
- scrape data at scale or through abusive automation without written permission;
- copy, resell or commercially exploit Platform content or features without permission;
- harass Operators, staff, Travelers or third parties; or
- use the Platform for unlawful activity or to violate third-party rights.
TakeMe Exploring may restrict functions, Bookings or accounts where reasonably necessary to protect the Platform, Users or the law, with notice and an opportunity to clarify where appropriate.
18 Intellectual property
The Platform, software, design, brand, logos, databases, text, images and other content belong to TakeMe Exploring, its licensors or Operators that authorized their use. Access grants only a limited, revocable, non-transferable and personal right to use the Platform. Unauthorized reproduction, modification, distribution, sale, decompilation or commercial exploitation is prohibited, subject to legal exceptions.
19 Third party services and links
The Platform may integrate maps, payments, communications, analytics, social media and other third-party services subject to their own terms and privacy notices. TakeMe Exploring does not control those systems but will manage its providers in accordance with applicable obligations.
20 Availability and maintenance
TakeMe Exploring seeks to keep the Platform secure and available but may temporarily suspend functions for maintenance, updates, incidents, demand or external causes. Reasonable support will be provided where an interruption affects a confirmed Booking.
21 Responsibility
Each party is responsible for legally attributable loss. The Operator selected by the Traveler is solely responsible for organizing and performing the Travel Service as published and confirmed. TakeMe Exploring is not responsible for physical performance merely because it operates the Platform or collects payment, but remains responsible for its own intermediary, information, payment, support and consumer-protection obligations where applicable.
To the fullest extent allowed by law, TakeMe Exploring is not responsible for loss caused exclusively by incorrect User information, failure to meet disclosed requirements, late arrival, no-show, Operator acts outside the Platform’s control, authority decisions, weather, closures or force majeure.
22 Privacy and personal data
TakeMe Exploring processes personal data for accounts, bookings, payments, support, fraud prevention, communications, legal compliance and service improvement. Necessary data may be shared with the selected Operator, technology providers, payment processors and authorities where a legal basis exists.
The complete processing details, retention, transfers, security and rights procedures must appear in a separate accessible Privacy Notice.

23 Communications and customer support
Booking communications may be sent to the email, telephone, messaging account or Platform account provided by the User. Users must monitor these channels, especially before the Service begins.
Main support channel: <support@takemeexploring.com>
Service hours and target response time: Monday to Sunday, 09:00 to 18:00 CET. Response time may take up to 6 hours, depending on the volume of requests.
For an issue, the User should provide the Booking number, facts and available evidence. During the activity, the Operator should be notified promptly where possible. TakeMe Exploring may mediate and request information from both parties.
24 Complaints and dispute resolution
A User may submit a complaint through the stated support channel. TakeMe Exploring will acknowledge it, investigate reasonably and provide a response or update within the applicable timeframe.
25 Changes to these Terms
TakeMe Exploring may update these Terms for legal, operational, technological or commercial reasons. The version applying to a Booking will generally be the version accepted at purchase, except for legally required or expressly accepted changes. Material future-use changes will be communicated reasonably and the current version will show its update date.
26 General provisions
If a provision is invalid or unenforceable, it will be interpreted or replaced only to the minimum extent necessary without affecting the remainder. Delay in exercising a right is not a waiver.
TakeMe Exploring may transfer its contractual position in a reorganization, sale or business transfer if User rights are not reduced and notice is given where required. A User may not transfer a named Booking or one prohibited from transfer by the Service policy without approval.
These Terms, the Specific Conditions, confirmation, Privacy Notice and linked policies form the framework governing Platform use and the Booking, always subject to mandatory law.
27 Jurisdiction
These General Terms and any dispute arising from or relating to the use of the Platform or a Reservation shall be governed by the applicable federal laws of Mexico and, where relevant, by the laws of the State of Quintana Roo.
Subject to any mandatory consumer-protection rights or jurisdiction that cannot lawfully be waived, the parties expressly submit to the competent courts located in Cancún, Municipality of Benito Juárez, Quintana Roo, Mexico, and waive any other jurisdiction that may otherwise apply by reason of their present or future domicile or for any other reason.
